"Service" refers to any watch repair, maintenance, or related work performed by kelvanen. "User" or "You" refers to any individual or entity that accesses our website or engages our services. "We," "Us," or "Our" refers to kelvanen, operating from 88 Jalan Maarof, Bangsar, 59000 Kuala Lumpur, Malaysia. "Agreement" refers to these Terms and Conditions in their entirety. By accessing our website or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or engage our services. You must be at least 18 years of age to enter into this agreement.

3. Service Description

kelvanen provides watch repair and maintenance services including Swiss movement servicing, bezel insert replacement, and quartz caliber replacement. All services are performed at our Bangsar workshop by qualified watchmakers. The specific scope of each service is discussed and agreed upon before work begins. We reserve the right to decline a service request if the work falls outside our capabilities or if we believe the repair is not in the client's best interest.

4. Service Process

When you bring a watch to us, we perform an initial assessment and provide a written explanation of our findings along with a cost estimate. Work begins only after you approve the proposed scope and pricing. If during the course of service we discover additional issues not covered in the original estimate, we will contact you to discuss the findings and seek approval before proceeding. We aim to complete services within the estimated timeframe, though delays may occur due to parts availability or unforeseen technical complications.

5. User Responsibilities

You are responsible for providing accurate information about your watch's history and any known issues. You agree to collect your watch within 30 days of being notified that service is complete. Watches not collected within 90 days of completion may be subject to storage fees. You agree not to use our website for any unlawful purpose, to interfere with website operations, or to misrepresent your identity when submitting enquiries.

6. Payment Terms

Service fees are quoted in Malaysian Ringgit (RM) and are payable upon completion of the service unless otherwise agreed. We accept cash, bank transfer, and major debit/credit cards. The quoted fee covers the agreed scope of work. Additional work discovered during the service process will be quoted separately and requires your approval before proceeding. We do not charge for initial assessments or consultations.

7. Intellectual Property

All content on our website, including text, images, graphics, logos, and design elements, is the property of kelvanen and is protected under applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent. You are granted a limited, non-transferable licence to access and use our website for personal, non-commercial purposes.

8. Limitation of Liability

kelvanen performs all services with reasonable care and professional skill. However, watch repair involves working with delicate mechanical and electronic components, and outcomes may vary depending on the condition and age of the timepiece. We are not liable for pre-existing defects or damage not related to our service. Our total liability for any claim arising from a service shall not exceed the fee paid for that specific service. We are not liable for indirect, incidental, or consequential damages.

9. Disclaimers

Our website and services are provided on an "as is" basis. While we strive for accuracy in all published information, we do not warrant that our website content is free from errors or omissions. Service timelines are estimates and not binding commitments. We do not make claims about specific outcomes beyond what is documented in the service record card provided upon completion.

10. Indemnification

You agree to indemnify and hold kelvanen harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our website, your breach of these Terms, or your violation of any rights of a third party.

11. Termination

Either party may terminate a service agreement by providing written notice. If you wish to cancel a service after work has commenced, you are responsible for payment of work completed up to the point of cancellation. We reserve the right to refuse or discontinue service to any individual at our discretion, provided we return the watch in its current state and refund any unused portion of prepaid fees.

12. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or our services shall first be addressed through informal negotiation. If a resolution cannot be reached within 30 days, either party may pursue mediation or refer the matter to the courts of Malaysia. The jurisdiction for any legal proceedings shall be Kuala Lumpur.

13. General Provisions

These Terms constitute the entire agreement between you and kelvanen regarding the subject matter herein. If any provision is found to be unenforceable, the remaining provisions shall continue in full force. Our failure to enforce any right under these Terms does not constitute a waiver of that right. We may assign our rights and obligations under these Terms without your prior consent. Any notices under these Terms should be directed to [email protected] or sent to our business address.

14. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with a revised effective date.
